Jensen Corporation Landscape Contractor v. McGuire & Hester; Cabrillo Community College District; Western Surety Co., No. CV167244 (filed Apr. 16, 2010).
Breach of contract. The plaintiff suffered additional labor and material costs due to delays caused by the acts and omissions of defendant McGuire and/or defendant Cabrillo College. Also the defendant has refused to take responsibility for the gophers and deer which were coming onto the Project grounds and impacting the plaintiff's work by destroying plant materials installed by the plaintiff, and resulting in increased labor and material costs.
(Emphasis added.) Somebody's got to take responsibility for the gophers. Do you know what gophers can do to a golf course?
